Welcome to Posture Pomodoro. By using our website, mobile application, or posture analysis tools (the "Service"), you agree to be bound by the following terms. If you do not agree to these terms, please do not use the Service.
1. Eligibility
You must be at least 18 years of age to use this Service. By uploading images or purchasing a report, you represent and warrant that you meet this age requirement. If you are under 18, you are not permitted to use Posture Pomodoro.
2. Medical Disclaimer (Not Medical Advice)
Posture Pomodoro is a wellness screening aid intended for educational and informational purposes only.
- Not a Medical Device: The Service is not a medical device and does not provide medical advice, diagnosis, or treatment.
- AI Limitations: Automated AI analysis can produce errors due to lighting, clothing, camera angles, or software limitations. The results should be treated as estimates, not clinical facts.
- Consult a Professional: Always seek the advice of a physician, physical therapist, or other qualified healthcare provider regarding any physical pain, discomfort, or medical conditions. Never disregard professional medical advice because of something you have read in a Posture Pomodoro report.
- Use at Your Own Risk: Use of this tool and any associated suggestions is entirely at your own risk.
3. Physical Activity & Exercise Safety
The Service may suggest corrective stretches or exercises.
- You should consult with a healthcare professional before starting any new exercise routine.
- If you experience pain, dizziness, or shortness of breath while performing any suggested movement, stop immediately.
- Posture Pomodoro is not responsible for any injuries that may occur while performing suggested activities.
4. User Conduct & Image Uploads
- Ownership: You may only upload images of yourself. Do not upload images of third parties without their express permission.
- Appropriate Attire: Users are expected to wear appropriate attire (e.g., gym wear, tight-fitting clothing) for accurate analysis.
- Prohibited Content: You are strictly prohibited from uploading naked, suggestive, or otherwise offensive imagery. We reserve the right to delete such content immediately and terminate your access to the Service without a refund.
5. Payments and Refunds
- Payments: All payments are processed securely through Stripe.
- Refund Policy: All sales for detailed posture reports are final. Because our reports are digital products delivered instantly upon purchase, we do not offer refunds once the report has been generated.
6. Limitation of Liability
To the maximum extent permitted by law, Posture Pomodoro and its operator (Kyle) shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to personal injury, inaccuracies in reports, or data loss arising out of your use of the Service. The Service is provided on an "as-is" and "as-available" basis.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
